This role will lead the implementation and day-to-day management of the Data Privacy program of the MPT and Pharma segments in WE geographies in accordance with Baxter Global Privacy Policy and GDPR policy, as well as the GDPR and other local privacy laws, supporting the EU DPO, HST & CPS Europe/ECEMEA.

This role will also manage Switzerland privacy compliance as the European Headquarters.

The role will have to partner as appropriate with senior functional leaders in order to:
(i) mobilize resources across the organization to implement the Data Privacy program, so that Baxter employees can achieve their business goals consistent with Baxter's values and standards and applicable data protection legal requirements, and (ii) enable the development and execution of innovative data-driven business initiatives while ensuring compliance with data privacy and data protection laws in the WE and Swiss geographies.


ROLE AND RESPONSIBILITIES

  • Act as the deputy of the Associate General Counsel, EU DPO, HST & CPS Europe/ECEMEA and implement the Baxter Privacy Office program being the first point of contact for the functions in WE and Swiss geographies.
  • Drive Baxter's GDPR compliance efforts and milestones, while building a culture of privacy.
  • Attend or facilitate the Privacy Office meetings and act as the first point of contact for the country Local Privacy Champions (LPCs).
  • Be able to act independently and provide expert legal advice and counsel to Baxter on privacy matters.
  • Provide leadership through leveraging of business and industry information to enable the business or region in identifying and solving business issues.
  • Partner and interact closely with country leaders and/or teams in the identification of privacy related issues and support the LPCs and the Associate General Counsel, EU DPO, HST & CPS Europe/ECEMEA in the efficient resolution.
  • Identify areas of vulnerability and risk and undertake corrective plans to resolve the issues.
  • Create awareness and perform trainings, as needed, following the Baxter Privacy Office Curriculum and functional needs.
  • Conduct or support internal investigations of allegations of potential data breaches.
  • Conduct privacy impact assessments under the supervision of Associate General Counsel, EU DPO, HST & CPS Europe/ECEMEA and the Baxter Privacy Office.
  • Draft and negotiate Data Processing Agreements with Baxter's vendors and customers.
  • Perform due diligence exercises on Baxter's potential partners from a data protection compliance standpoint.
  • Maintain up to date privacy expertise, skills, and competency regarding evolving laws, regulations, guidance, and directives impacting Baxter internationally.
  • Law Degree from an EU jurisdiction and bar membership.
  • Healthcare experience required. Medical Device and international experience strongly preferred.
  • Expert knowledge of global data privacy laws, including the GDPR.
  • Experience in managing data incidents and breaches.
  • Proven experience with counseling business clients on an international level.
  • Ability to work independently and navigate ambiguous legal issues.
  • Proven track record in working with others in addressing privacy issues in a pragmatic way and within complex organization environment.
  • High degree of accountability, professional motivation, and drive with the resulting ability to thrive in a resultsoriented culture while driving excellence to optimize the execution of transactions.
  • Proven history of proactively identifying and researching legal risks and issues and effectively counselling clients regarding same providing actionable risk mitigation strategies.
  • Strong ability to work with and coordinate activities across a large number of individuals across various functional areas and effectively communicate the impact of law and regulation on business operations in a solutionsoriented manner.
  • Fluency in English. Ability to work in other EU languages will be considered as a plus.
